By using our sites, you confirm that you accept these terms of use and that you agree to comply with them.
If you do not agree to these terms of use, you must not use any of our sites.

We are registered in England and Wales under company number 02721319 and have our registered office and trading address is at Minerva House Minerva Business Park, Lynch Wood, Peterborough, Cambridgeshire, United Kingdom, PE2 6FT.

We are a private limited company.

We may revise these terms of use at any time by amending this page.
Please check this page from time to time to take notice of any changes we made, as they are binding on you.
ACCESSING OUR SITE
We do not guarantee that our sites, or any content on them, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason any of our sites are unavailable at any time or for any period.
You are responsible for making all arrangements necessary for you to have access to our sites.
You are also responsible for ensuring that all persons who access our sites through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
YOUR ACCOUNT AND PASSWORD
Only members are granted access the restricted members-only parts of our sites which become available when they log in to their registered account. Login credentials are provided to new members who may then elect to change their password if they wish by logging into their account/New members will have the chance to create a login. These credentials must be treated as confidential and not disclosed to any third parties or shared with non-members.
We have the right to disable any of our members’ registered accounts, regardless of whether their password was chosen by that member or allocated by us, at any time, if in our reasonable opinion that member has failed to comply with any of the provisions of these terms of use.
If you know or suspect that anyone other than you or anyone outside of your organisation knows your or your organisation’s login credentials, you must promptly notify us at info@freshproduce.org.uk.
We may suspend or terminate (at our sole discretion) at any time any members’ registered account’s ability to use our sites if:
- they do not, within a reasonable time of us asking for it, provide us with information that is necessary for the convenient and efficient administration of any of our sites, for example, updated contact or payment details; or
- they do not comply in any material respects with these terms.
INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property rights across our sites, and for the material published on them. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our sites for your personal use and you may draw the attention of others within your organisation to content posted on our site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.
You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
NO TEXT OR DATA MINING, OR WEB SCRAPING
You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our site or any services provided via, or in relation to, our site. This includes using (or permitting, authorising or attempting the use of):
- Any “robot”, “bot”, “spider”, “scraper” or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the site or any data, content, information or services accessed via the same.
- Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.
The provisions in this clause should be treated as an express reservation of our rights in this regard. This, clause shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.
NO RELIANCE ON INFORMATION
The content on our sites is provided for general information only, as are any hyperlinks which we provide to other websites. Neither the content published on our own sites nor fact we have published a hyperlink to a third-party website are intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our sites.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

- use of or reliance on any content displayed on any of our sites; or
- use of, inability to use or reliance on any hyperlinks to third-party websites which are published on our sites.
If you are a business user, please note that in particular, we will not be liable for:

- loss of anticipated savings;
- loss of business opportunity, goodwill or reputation; or
- any indirect or consequential loss or damage.
If you are a consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will not be liable for any loss or damage caused by any malicious and technologically harmful material (as defined in the relevant section of these terms below) that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our sites or to your downloading of any content on it, or on any website linked to it.
We assume no responsibility for the content of websites linked on our sites. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any goods or services to you.
UPLOADING CONTENT TO OUR SITE
Whenever you make use of a feature that allows you to upload content to our sites, or to make contact with other users of our sites (together regarded as posting to our sites), you must comply with the content standards set out in our Acceptable Use Policy. We also have the right to remove any posting you make on our sites if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.
You warrant that any such contribution does comply with those standards, and you will be liable to us and will be required to indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
Any content you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose.
To the extent that we are able to do so whilst also remaining compliant with current GDPR, privacy laws and our own privacy policy we also have the right to disclose your identity to any third party who claims that any content posted or uploaded by you to any of our sites constitutes a violation of their intellectual property rights, or of their right to privacy. In posting on any of our sites you acknowledge that whilst we generally will not disclose your identity to third parties, we may do so in this specific and limited instance.
We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other users of our sites.
The views expressed by other users on our site do not represent our views or values.
MALICIOUS AND TECHNOLOGICALLY HARMFUL MATERIAL
For the purposes of these terms “malicious” and “technologically harmful” material are defined as including cyber-attacks, denial of service attacks, trojans, viruses, worms, logic bombs and any other method of technological attack which is malicious or technologically harmful.
We do not guarantee that our site will be secure or free from malicious and technologically harmful material.
You are responsible for configuring your information technology, computer programmes and platform in order to access our sites. You should use your own cyber security and protection software.
You must not attempt to gain unauthorised access to our sites, the server on which our sites are stored or any server, computer or database connected to our sites. You must not attack our sites via a denial-of-service attack, a distributed denial-of service attack or through the use of any other malicious and technologically harmful material or software. By breaching this provision, you would by committing a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them so far as we are able given the GDPR and privacy laws in place at the time of the breach. In the event of such a breach, your right to use our sites will cease immediately and if you have a registered account this would be terminated.
LINKING TO OUR SITE
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link to our site in any website that is not owned by you.
